The following terms and conditions of sale (“Conditions of Sale”) apply to the sale of any entry tickets or use of the services and facilities with Lulutots Daycare, LLC (“WOW Kids Playground”, “we”, or “us”).

IMPORTANT NOTICE – YOUR ENTRY AND USE OF THE SERVICES AND FACILITIES ARE CONDITIONAL UPON YOUR ACCEPTANCE OF THE CONDITIONS OF SALE. PLEASE READ THESE TERMS CAREFULLY AS THEY MAY AFFECT YOUR LEGAL RIGHTS.

The Waiver, Privacy Policy, House Rules, Product and Service Terms and Condition (T&C) (collectively, the “Appendices”) are incorporated by reference into the Conditions of Sale and shall form part of your agreement with Us. The Conditions of Sale are available at any time for your reference on our website at www.wowkidsplayground.com (“Website”), and may be revised, supplemented and amended from time to time.

All capitalized terms used and not defined herein shall have the respective meanings ascribed to them under the Appendices.

All Participants under the age of 12 (the “minor”) must be supervised by a responsible adult. Where a Participant is responsible for a minor (whether as legal guardian or otherwise), the Participant agrees to be bound by these Conditions of Sale on the minor’s behalf. The Participant takes responsibility for the minor’s safety and must directly supervise them at all times.

While in any of WOW Kids Playground Venue, you consent to images and video being taken for security or promotional purposes of you and minors for whom you are responsible. We have installed CCTV for the purposes of crime prevention and public safety. Such images and videos will be the exclusive property of WOW Kids Playground and you agree to the free publication and/or use in any form or media whatsoever of such images and videos, without payment or compensation. You may withdraw your consent at any moment by contacting our staff through our Website, and we shall remove such images from our publicity materials as soon as practicable. You must comply with all our signs or other directions or we may suspend or cancel your access to recreational activities at any of our venues in our absolute discretion for non-compliance with these conditions, or for reckless or careless conduct. Participants must be in good health and physical condition and free from any medical conditions which may affect or preclude them from safely participating in any activities.

WOW Kids Playground, in its absolute discretion, reserves the right to change Our operating dates and hours, remove or cancel all or any activities or areas within the park for any reason including but not limited to technical, health and safety and/or operational reasons or due to special events or private functions. For the avoidance of doubt, the full value or any part of the value of the ticket will not be refunded nor will any compensation be payable if any of the advertised activities or areas are removed or closed during the visit.

If you choose to use any locker or storage facilities offered by Us, We do not recommend storing any valuables there. We will not be responsible for any loss or damage to property stored in any locker or storage facilities at Our venue (whether arising from Our negligence or otherwise).

Participants must look after their own belongings at all times. Items such as phones and cameras may get damaged if they are used and WOW Kids Playground shall not be liable for any loss or damage to any Participant’s property (howsoever caused) in the course of engaging in any WOW Kids Playground Activities.

In the event that the purchaser is purchasing the tickets/passes for third parties, the purchaser shall procure that the Adults of all Participants, the purchaser’s agents and/or affiliates have read and agreed with the Conditions of Sale.

By entering WOW Kids Playground Venue, you are deemed to have read and agreed with the Conditions of Sale, and agreed to be bound by them.

Website Terms of Use

Please read these Website terms of use carefully before using the WOW Kids Playground website. By using the Website, you are agreeing to be bound by these terms.

The Website is provided by Lulutots Daycare, LLC dba WOW Kids Playground.

The Website may provide links to third party websites and the products or services of third parties. WOW Kids Playground is not responsible and is not liable in any way for third party content provided on or through the Website. Your access or use of the third-party sites is at your own risk.

The Website may from time to time display third party advertisements. Such advertisements may or may not contain hyperlinks to third party websites. WOW Kids Playground does not endorse or recommend the goods or services of such advertisers or their websites. If you purchase any goods or services from them or visit any of their websites, you do so at your own risk.

Copyright in the Website and all the content on it, including but not limited to the service description, photographs and logos (“Website Content”), is owned by WOW Kids Playground or its licensors. You are not permitted to use, copy, modify or distribute the Website Content without our written consent. However, you are permitted to “share” certain Website Content on social media sites, by the use of social media plug-ins where these are made available.

The Website may contain trademarks or logos of WOW Kids Playground, other companies or organizations and these are proprietary to the owner(s) of such marks.

WOW Kids Playground may at any time discontinue or limit access to the Website or its content. WOW Kids Playground may terminate or limit your access to the Website if you breach these Conditions of Sale. All disclaimers and limitations of liability by WOW Kids Playground will survive termination.

Ordering Procedure

You may offer to purchase any of the WOW Kids Playground products described on the Website for the price specified on the Website.

Your order must contain your name, phone number, e-mail address, credit card details and any other ordering information specified on the Website. Personal information is processed by us in accordance with our Privacy Policy.

Payment must be effected by credit card using the ordering facility on the Website.

Confirmation of your order will be sent to your nominated email address once your payment for the transaction has been cleared. If you do not receive a confirmation email within five business days, please contact info@wowkidsplayground.com.

You may not cancel an order once it has been submitted and paid, even if you have not received a confirmation email from WOW Kids Playground.

If you wish to purchase a WOW Kids Playground product by telephone or by visiting the WOW Kids Playground Venue then any such purchase will be governed by these Conditions of Sale (excluding any part of the Conditions of Sale that are specific to purchases made using the Website), and such other conditions as may be informed to you over the telephone or displayed at the WOW Kids Playground Venue (as the case may be).

Your ticket(s) will be delivered by email. Please ensure a valid email address is given during purchase.

Pricing

The prices of the WOW Kids Playground products shall be the prices displayed on the Website on the date of your order. There may occasionally be an error in the price displayed on the Website, and we shall refund you any excess.

All prices displayed on the Website are quoted in US dollars and must be paid in full, subject to any discounts which are offered as detailed on the Website at the point of such purchase.

Cancellation due to error or unavailability

You acknowledge that despite WOW Kids Playground’s reasonable precautions, WOW Kids Playground’s products may be listed at an incorrect price, with incorrect information, or which are unavailable due to an error or other oversight. In these circumstances, WOW Kids Playground reserves the right to cancel the transaction, notwithstanding that your order has been confirmed and your credit card has been charged.

If a cancellation of this nature occurs after your credit card has been charged for the purchase, WOW Kids Playground will promptly issue a credit to your credit card account for the amount in question.

Cancellation for other reasons

Under normal circumstances, a confirmed order will enable you to engage in the activities specified in your order at the WOW Kids Playground Venue. However, there may be circumstances in which we are unable to make the WOW Kids Playground Venue or WOW Kid Playground Facilities available on the date or at the time allocated. This may be as a result of unexpected closure of the WOW Kids Playground Venue, damage to the WOW Kids Playground Facilities rendering them unsafe, insufficient staff availability, Act of Nature, any instrument, or any regulation or regulations of any federal, state or local authority or otherwise. We reserve the right to cancel the tickets at short notice in less than 24 hours. In such circumstances, we will inform you of the situation and either refund the ticket price or allow you to reschedule (where this is possible). WOW Kids Playground shall not be liable for travel costs or any other losses in connection with such cancellation.

Details of conditions applicable to purchase of WOW Kids Playground products

Details of the conditions applicable to the purchase of WOW Kids Playground products on the Website may differ from time to time. WOW Kids Playground reserves the right to make any changes to the details and these Conditions of Sale if necessary to comply with any applicable laws and to change the details and conditions published on the Website, without affording prior notice, provided that this does not materially affect the nature of the WOW Kids Playground products purchased by you, and your continued use of the WOW Kids Playground products and/or the WOW Kids Playground Website shall constitute your acceptance of and agreement to such amended Conditions of Sale. Please check this Website regularly for the most up-to-date version of the Conditions of Sale.

Order submission and your agreement to these Conditions of Sale

When you click on the “I Agree” checkbox you agree to these Conditions of Sale and WOW Kids Playground will treat this as a binding order. You are responsible for ensuring the accuracy of your order. Upon confirming your order, WOW Kids Playground shall supply you, subject to availability, with WOW Kids Playground products set out in your order. WOW Kids Playground will normally confirm each order made online via the Website or by email within five business days.

Once you have submitted an order, your payment will be non-refundable, even if you decide not to use the ticket(s) ordered.

Security Policy

When purchasing from the Website, your financial details will pass through a secure server.

No transmission over the Internet can be guaranteed as totally secure. WOW Kids Playground strives to protect such information, it does not warrant and cannot ensure the security of any information which you transmit through it. Accordingly, any information which you transmit to WOW Kids Playground, including your credit card details, is transmitted at your own risk and to the fullest extent permitted by law, WOW Kids Playground shall have no liability to you for any financial or consequential loss or damage suffered by you in anyway whatsoever arising out of or related to your use of the Website, whether due to negligence, breach of contract, statute or statutory duty by WOW Kids Playground.

Once WOW Kids Playground receives your transmission, it will take reasonable steps to preserve the security of such information.

Some of the information submitted by you through the Website will contain personal information. Details about how such personal information is collected, processed, used and/or transferred by WOW Kids Playground is set out in the Privacy Policy.

Holidays

We will observe the Federal holidays that include the following:

Many of these Holiday days above land on weekdays so please be aware those days will be charge Holiday general admission rates & Holiday birthday/event party rates. We reserve the right to include or exclude more holidays if necessary, but this is our current list.

General

Each of the terms of these Conditions of Sale shall be subject to and shall apply to the fullest extent permitted by law.

Any provision stated herein which is held to be illegal, invalid or unenforceable will be ineffective solely to the extent of such illegality, invalidity or unenforceability, without affecting the other provisions herein which shall remain in full force and effect, and will be deemed to be amended as necessary to give effect as close as possible to the intent and purposes of the illegal, invalid or unenforceable provision.

These Conditions of Sale shall be governed by and construed in accordance with the laws of the State of California, without reference to its choice of law provisions, and the federal or state courts of San Francisco shall have exclusive jurisdiction over any dispute arising in connection with these Conditions of Sale.  If any of these terms and conditions are found unlawful, void or for any reason unenforceable, then that provision will be considered severable from the remaining terms and conditions, and will not affect the validity and enforceability of the remaining provisions.

Product and Service Terms and Conditions (T&C)

The following product and service T&C apply to the sale of any entry tickets, voucher, pass, product and/or use of the services and facilities with Lulutots Daycare, LLC (“WOW Kids Playground”, “we”, or “us”).

The Product and Service T&C  shall form part of your agreement with Us. The Conditions of Sale and may be revised, supplemented and amended from time to time.

General Admission Ticket / Gift Voucher

• Valid for one Participant and one accompanying Adult only.
• General Admission Ticket Valid for date of issue. Gift Vouchers valid for one year from date of issue (One year = 365 days).
• Valid for all day play (subject to change), and on the same day only.
• This Admission Ticket/Gift Voucher is non-refundable, not for re-sale, cannot be exchanged for cash, and cannot be replaced if lost, damaged or expired.
• Purchaser acknowledges that he/she has read, understood and accepted the Conditions of Sale which are set out at www.wowkidsplayground.com and the same are duly incorporated herein.
• In the event that the purchaser is purchasing the Tickets/Voucher for third parties, the purchaser shall procure that the Adults of all Participants, the purchaser’s agents and/or affiliates have read and agreed with the terms and conditions of herein and the Conditions of Sale as stated on the Website at www.wowkidsplayground.com.
• By purchasing this ticket/pass/card, you are deemed to have read and agreed with the Conditions of Sale, and agreed to be bound by them.
• In the event of any dispute, the decision of WOW Kids Playground is final.

5x / 10x Admission Multi-Visit Pass

• Valid for one year from date of issue (One year=365 days).
• Valid for all day play time per admission.
• The 5x / 10x Admission Multi-Visit Pass must be presented at time of admission. Each admission allows entry of one Participant and one accompanying Adult.
• Non-refundable and cannot be exchanged for cash.
• Up-to-date Waiver is required.
• Purchaser acknowledges that he/she has read, understood and accepted the terms and conditions of the Conditions of Sale which are set out at www.wowkidsplayground.com and the same are duly incorporated herein.
• Passes do not guarantee admission, especially during high attendance, over capacity periods, in which a wait time may apply.
• In the event that the purchaser is purchasing the 5x / 10x Admission Multi-Visit Pass for third parties, the purchaser shall procure that the Adults of all Participants, the purchaser’s agents and/or affiliates have read and agreed with the terms and conditions of herein and the Conditions of Sale as stated on the Website at www.wowkidsplayground.com.
• By purchasing this ticket/pass/card, you are deemed to have read and agreed with the Conditions of Sale, and agreed to be bound by them.
• In the event of any dispute, the decision of WOW Kids Playground is final.
• Lost card replacement – $5.00 card re-issue fee.

Membership Pass

• Each visit can only be used during our normal operating business hours and cannot be used toward any other promotions or programs.
• Passes are sold per person.
• Passes do not guarantee admission, especially during high attendance, over capacity periods, in which a wait time may apply.
• Each pass admission allows entry for one child only with one accompanying adult.
• Up-to-date Waiver is required.
• Lost card replacement – $5.00 card re-issue fee.
• The Membership Pass must be presented at time of admission.
• Each Membership Pass sold as Monthly, meaning each pass will be good for 30 days from date of purchase.
• Purchaser acknowledges that he/she has read, understood and accepted the terms and conditions of the Conditions of Sale which are set out at www.wowkidsplayground.com and the same are duly incorporated herein.
• In the event that the purchaser is purchasing the Monthly Passes for third parties, the purchaser shall procure that the Adults of all Participants, the purchaser’s agents and/or affiliates have read and agreed with the terms and conditions of herein and the Conditions of Sale as stated on the Website at www.wowkidsplayground.com.
• By purchasing this ticket/pass/card, you are deemed to have read and agreed with the Conditions of Sale, and agreed to be bound by them.
• In the event of any dispute, the decision of WOW Kids Playground is final.

Gift Card

• Gift Cards can ONLY be bought at physical location site. Not sold through website.
• No Cash Redemption. The Cards have no cash value and may not be redeemed for cash except as required by applicable law.
• A Card is not valid for use until it has been activated.
• The Issuer reserves the right to refuse to honor any Card in the event of a disputed credit card charge or other failure of consideration.
• The maximum load, reload and total balance of any Card is $100.
• For Card balance inquiries, call 1-415-775-9090 or visit our front desk. The balance obtained by a Cardholder when inquiring over the telephone or online is an estimate only. In most cases, the balance is adjusted immediately when a Cardholder makes a purchase, but there may be occasions when the balance adjustment is delayed.
• Passes do not guarantee admission, especially during high attendance, over capacity periods.
• Passes are non-transferable.
• The Cards are not refundable except as required by applicable law. Products and services purchased using a Card will be subject to the return policy of WOW Kids Playground and Good Earth Cafe. Some exceptions may apply.
• The Cards may not be resold without the Issuer’s express written authorization. A Card is not valid and will not be honored, and the Issuer will not be liable for the value of the Card.
• Lost, Damaged or Stolen Cards.  A lost, damaged or stolen Card may be replaced for a $5 replacement fee. The Issuer is not responsible for unauthorized use of any Card.
• Gift Card cannot be exchanged for cash or credit balance.
• The value in the Gift Card is non-transferable and cannot be combined with other card’s value.
• Gift card is valid for use on WOW Kids Playground products and services. Some exceptions may apply.
• WOW Kids Playground will not be responsible for any loss, damage, theft or unauthorized use of this gift card. Lost or stolen cards will not be replaced.
• In the event that the purchaser is purchasing the Gift Card for third parties, the purchaser shall procure that the Adults of all Participants, the purchaser’s agents and/or affiliates have read and agreed with the terms and conditions of herein and the Conditions of Sale as stated on the Website at www.wowkidsplayground.com.
• By purchasing this ticket/pass/card, you are deemed to have read and agreed with the Conditions of Sale, and agreed to be bound by them.
• In the event of dispute, the decision of WOW Kids Playground is final.

Physical Discount Voucher

• This discount voucher is valid for 1 to 6 months from the date of issue.
• This voucher is applicable only for walk-in purchase of Single Admission Ticket.
• Only one voucher can be use per transaction.
• This voucher has to be presented before purchase. Any photocopy, e-copy or any other type of copy of the discount voucher will not be accepted.
• This voucher cannot be used in conjunction with any other discounts, special offers and/or vouchers, unless otherwise stated.
• This voucher will not be accepted if torn or defaced. WOW Kids Playground will not be responsible for the loss or damage of this voucher.
• In the event that the purchaser is purchasing the Discount Voucher for third parties, the purchaser shall procure that the Adults of all Participants, the purchaser’s agents and/or affiliates have read and agreed with the terms and conditions of herein and the Conditions of Sale as stated on the Website at www.wowkidsplayground.com.
• By taking this discount voucher, you are deemed to have read and agreed with the Conditions of Sale, and agreed to be bound by them.
• In the event of any dispute, the decision of WOW Kids Playground is final.

School/Group Visits

• School visit reservations should be made at least 2 weeks in advance.  We will accommodate later reservations subject to availability.
• School visits are available Monday to Friday Only, excluding School Holidays. To view which Holidays we observe, please check our Playground Information FAQ page. On those Holidays, some of those days land on a weekday (Mon.-Fri.), so please be aware we will not have School Visits on those days. Our available hours for school visits are 10:00am-3:00pm.
• 50% non-refundable deposit required upon confirmation of reservation.  Remaining balance due on event day.  NO CANCELLATION or REFUND after confirmation. 
• Signed waivers are required for each chaperone and student before entering the playground.  Parent or guardian must sign for minors.  Please save time by signing the waiver online in our website.
• Each school visit must be accompanied with a minimum of two chaperones, with larger groups may require more. We require a 4:1 ratio of students/child to teacher/adult chaperone. Admission is free for the teacher/adult chaperones.
• Temperature checks may be required for entry to playground.  WOW Kids Playground reserves the right to refuse or remove entry to anyone who appears to be ill.
• We recommend that children wear comfortable clothing and grip socks to help maximize safety and general hygiene.  A complimentary grip sock is available to each child with the school visit package. 
• All items, belonging and personal properties brought into the playground shall be at your own risk, and WOW Kids Playground accepts no liability for the loss or damage or such items.
• Please observe playground rules and regulations as posted in the playground and website.
• In the event that the purchaser is purchasing the School/Group Visit for a third parties, the purchaser shall procure that the Adults of all Participants, the purchaser’s agents and/or affiliates have read and agreed with the terms and conditions of herein and the Conditions of Sale as stated on the Website at www.wowkidsplayground.com.
• By purchasing a School/Group visit, you are deemed to have read and agreed with the Conditions of Sale, and agreed to be bound by them.
• In the event of dispute, the decision of WOW Kids Playground is final.

WOW Arcade Game Card

• No Cash Redemption. The Cards have no cash value and may not be redeemed for cash except as required by applicable law.
• A Card is not valid for use until it has been activated.
• The Issuer reserves the right to refuse to honor any Card in the event of a disputed credit card charge or other failure of consideration.
• The WOW Arcade Game Card is rechargeable. The maximum load, reload and total balance of any Card is $100. The value in the WOW Arcade Game Card is non-transferable and cannot be combined with other card’s value.
• The WOW Arcade Game Card is valid for use on the WOW Kids Playground premise.
• WOW Kids Playground will not be responsible for any loss, damage, theft, or unauthorized use of this arcade game card. Lost or stolen cards will not be replaced.
• In the event that the purchaser is purchasing the WOW Arcade Game Card for third parties, the purchaser shall procure that the Adults of all Participants, the purchaser’s agents and/or affiliates have read and agreed with the terms and conditions of herein and the Condition of Sale as stated on the Website at www.wowkidsplayground.com.
• By purchasing this ticket/pass/card, you are deemed to have read and agreed with the Conditions of Sale, and agreed to be bound by them.
• In the event of dispute, the decision of WOW Kids Playground is final.
